GovTechCon Ticketing Terms & Conditions
PLEASE READ THIS AGREEMENT CAREFULLY IN ITS ENTIRETY. THIS AGREEMENT IS LEGALLY BINDING AND INCLUDES RESTRICTIONS, LIMITATIONS (INCLUDING ON LIABILITY), ASSUMPTIONS OF RISK, AND A NO-REFUND POLICY. BY ENTERING INTO THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU ARE FREELY AND VOLUNTARILY GIVING UP IMPORTANT LEGAL RIGHTS. IF YOU DO NOT AGREE WITH ANY TERMS, WAIVERS, LIMITATIONS, RESTRICTIONS, OR CONDITIONS IN THIS AGREEMENT, OR IF YOU DO NOT AGREE TO ASSUME THE RISKS SET FORTH, DO NOT PURCHASE A TICKET, REGISTER FOR THE EVENT, ENTER THE VENUE, AND/OR ATTEND THE EVENT.
The hours for GovTechCon (“Event”) will be from 8:00 am EST on December 18, 2024, to 5:00 pm EST on December 20, 2024. In order for the purchaser and/or holder (hereinafter referred to as you “You” or “Your”) of a valid wristband or ticket (“Ticket”) to enter the Event, You must possess a valid Ticket that permits access to the Event and check in at marked locations during specified time periods. Please allow ample time to check in.
ARTICLE 1: YOUR TICKET
Acceptance of Terms. The purchase and/or use of a Ticket to, and/or entry into, the Event constitutes your unconditional acceptance of all terms and conditions in this agreement (this “Agreement”) between you and GovTech Foundation (the “Company”). 
Access. Attendance limits are determined solely by the Company and may not reflect the Event's full capacity, only the number of people the Company decides to admit. You acknowledge that a general admission Ticket shall only provide you entrance into the general admission areas of the Event and that to enter the VIP areas You must possess a VIP Ticket. All the people attending the Event are required to possess a Ticket to enter the Event.
Event Changes and Modifications. The Company reserves the right to change, modify, or alter any aspect of the Event (including speakers, hosts, moderators, venue, time, and policies) at any time, for any reason, without prior notice or compensation. 
The names of speakers, hosts, or moderators in any promotional material are for informational purposes only. They do not represent the importance, headline status, or duration of participation at the Event and are subject to change without prior notice.
Ticket Sales and Refunds. EXCEPT AS EXPLICITLY OTHERWISE PROVIDED HEREIN, YOU UNCONDITIONALLY UNDERSTAND AND ACKNOWLEDGE THAT ALL TICKET SALES ARE FINAL. THERE WILL BE NO TICKET REFUNDS AND/OR TICKET EXCHANGES EXCEPT AS REQUIRED BY APPLICABLE LAW. THE EVENT IS A RAIN OR SHINE EVENT. BY PURCHASING NON-REFUNDABLE TICKETS, YOU AGREE NOT TO INITIATE CHARGEBACKS or undertake any similar action(s) that operates, in any way, to dispute, cancel or reverse any portion of a prior transaction (“Chargeback(s)”). You acknowledge and agree that by entering into this Agreement, You are voluntarily and knowingly agreeing to give up certain of Your legal rights relating to Your entitlement to Chargebacks or to Chargeback protections.
Assumption of Risk and Liability Waiver. By entering the Event, You assume any and all risk and/or danger, known and unknown, foreseeable and unforeseeable, resulting from, or incidental to, the Event, whether occurring prior to, during, or subsequent to, the Event, including, but not limited to, any death, personal injury, loss of property, or any other loss, damage or liability whatsoever. Your Ticket is contingent upon Your voluntary assumption of the risk and danger that may result from, or be incidental to, Your presence at the Event, whether occurring prior to, during or after the Event, including, but not limited to, any actions or omissions of the Company.
ARTICLE 2: SECURITY CHECK
The Event is an opportunity to share information, increase knowledge, network, and build business relationships. We support the open exchange of ideas and a harassment-free experience while maintaining security. Access to the Event site is prohibited for individuals engaging in illegal, disruptive, or harmful behavior, which is in line with ensuring a safe and inclusive environment.
Access to the Event site is PROHIBITED and refused to, but not limited to, people who:

- Are under the influence of illegal drugs or any other illegal substances.
- Are intoxicated, as determined by Event staff, impairing their state.
- Have been previously banned from other events by the organizer, the Company, the administration or legal authorities.
- Intend to disturb the peace or to provoke others to do so.
- Engage in fighting or disruptive behavior.
- Use foul language.
- Wear clothing with obscene or indecent language.
- Resist the direction of and/or a search by the Event security.
- Act in violation of the provisions of one or more articles of these regulations or in the spirit thereof.
The Event is an opportunity to share information, increase knowledge, network, and build business relationships. ARTICLE 3: NAME, IMAGE, LIKENESS
By attending the Event, You understand, agree and acknowledge that (i) You may be photographed and filmed, and (ii) You hereby provide the Company with Your absolute, express consent to be photographed and filmed. You further understand and agree that these images and/or recordings can be registered, stored, transmitted, broadcast/streamed, rebroadcast, distributed, and sold for archival, promotional, and/or commercial purposes, in any manner, and in any media, now known or hereafter discovered or conceived, without any compensation to You. Your name, image and/or Your likeness may be captured as part of and/or used in connection with any broadcast/stream, audio, visual, or audio-visual recording, photograph, or other reproduction or other publication of the Event (the “Footage”) and may also be used by or on behalf of the Company or any of the Company’s parent entities, subsidiaries, affiliates, partners, sponsors, officers, shareholders, successors, licenses or assigns for any purpose, including, but not limited to, archival, promotional, and commercial purposes, without any compensation to You. You waive all other rights in and to the Footage, including, but not limited to, all claims of so-called moral rights. This Footage may also be used to identify and prosecute illegal or impermissible conduct.
There will be camera surveillance at the Event to ensure safety and proper operation. The Footage may be registered or stored by the Company or governmental authorities for security and safety purposes and to enforce compliance with safety regulations.
Any recordings made by ticketholders on or near the Event site may not be used for commercial or public purposes, without the Company consent (including, without limitation, video sharing websites).
ARTICLE 4: INDEMNIFICATION
You hereby indemnify and hold harmless the Company, including its respective representatives, officers, directors, owners, members, trustees, agents, employees, successors, licenses and assigns; Event sponsors/promoters, including, but not limited to, their respective management, their agents, their staff and their designees (collectively, the “Company Parties”) from any loss, liability, damage or cost in any way arising out of, or related to, Your actions and omissions at, around, or while traveling to and from, the Event. This includes claims, causes of action, lawsuits, charges, complaints, controversies, damages, costs, or experiences of any kind, nature, or description, whether direct or indirect, foreseen or unforeseen, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, arising out of, or related to, the Event, Your attendance at the Event, or Your travel to and from the Event, except to the extent caused by the gross negligence or willful misconduct of the Company Parties.
Limitation of Liability: IN NO EVENT WILL THE COMPANY PARTIES OR THEIR SUPPLIERS, VENDORS, ADVERTISERS AND SPONSORS, BE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, DIRECT, INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OR LOST PROFITS, REVENUES OR BUSINESS OPPORTUNITIES, OR OTHER DAMAGES OF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, ARISING OUT OF, OR IN CONNECTION WITH, THE EVENT OR ANY PRODUCT OR SERVICE PURCHASED AT THE EVENT, EVEN IF THE COMPANY PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT, OR OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE COMPANY PARTIES WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR (a) ANY FAILURE OF ANOTHER ATTENDEE OR PARTICIPANT OF THE EVENT TO CONFORM TO THESE RULES, (b) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, WHETHER ARISING IN CONTRACT OR IN TORT, RESULTING FROM YOUR ATTENDANCE AT THE EVENT, (c) ANY ERRORS, MISTAKES, INACCURACIES OR OMISSIONS IN ANY CONTENT, OR (d) ANY LOST, STOLEN OR DAMAGED TICKETS, LOST OR STOLEN PROPERTY, OR FAILURE OF EVENT STAFF OR SECURITY TO HONOR YOUR TICKET. THE LIMITATIONS IN THIS ARTICLE WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS ITS ESSENTIAL PURPOSE. THE ALLOCATION OF RISK BETWEEN US IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN US. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF DAMAGES, SO THESE MAY NOT APPLY TO YOU. IN SUCH CASES, THE COMPANY PARTIES’ LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE BY YOU.
ARTICLE 4: INDEMNIFICATION
Taxes: Taxes, which are added to the face value of Your Ticket on checkout, refer to assessments, sales and use taxes as assessed by governmental authorities.
Additional Fees and Ancillary Services. Additional Fees refer to costs added to the face value of Your Ticket on checkout, including delivery charges, merchant processing costs, fulfillment fees, customer service support, program administration fees, surcharges, and facility fees paid to third-party venue owners and operators, and fees paid to third-party ticketing processors. You acknowledge and agree that all services related to Additional Fees are critical to Your Ticket offering and sale process (collectively the “Ancillary Services”) and have independent, distinct, and essential value. You acknowledge and consent to the increase in Your Ticket price due to the incorporation of such Ancillary Services, which is reasonable.
Economic Interests. You hereby acknowledge that Company has an economic interest in and to receipts generated from the face value of Your Ticket. The Company may have an economic interest in one or more components of the Additional Fees being charged to You through related party business transactions and affiliations. Company retains no economic interest in and to Taxes collected from You.
EVENT FORMAT. “AS-IS”. COMPANY GRANTS THIS LICENSE TO BEARER TO ENTER THE VENUE ON AN “AS IS” AND ON AN “AS AVAILABLE” BASIS. COMPANY OFFERS NO WARRANTIES OR GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE AVAILABILITY OF TICKETS, THE PURCHASE OF TICKETS, THE EVENT, THE VENUE, OR THE SPEAKERS. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OR GUARANTEES RESPECTING THE AVAILABILITY OF POTENTIAL SEATING, SITE CONFIGURATIONS, FOOD, BEVERAGE AND/OR MERCHANDISE CHOICES OR AVAILABITY, VIEWING CAPACITY, FORMAT, SITE CONFIGURATION, PRODUCTION QUALITY AND/OR OVERALL PRODUCTION EXPERIENCE. IF YOU DO NOT AGREE WITH OR DO NOT INTEND TO BE BOUND BY THESE TERMS, DO NOT PURCHASE A TICKET, DO NOT REGISTER FOR OR UTILIZE COMPANY’S SERVICES AND OR DO NOT ENTER THE VENUE OR ATTEND THE EVENT.
Notice. In no event shall the Company Parties be liable for any claim unless written notice is given within six (6) months from the date of the loss. No suit for any cause may be maintained against the Company Parties unless it is commenced within one (1) year after the Event.
Disputes. YOU HEREBY ACKNOWLEDGE AND AGREE THAT ANY DISPUTE IS LIKELY TO INVOLVE COMPLICATED AND DIFFICULT ISSUES, AND THEREFORE, YOU KNOWINGLY, VOLUNTARILY, INTENTIONALLY, IRREVOCABLY AND UNCONDITIONALLY WAIVE ANY RIGHT YOU MAY HAVE TO A TRIAL BY JURY IN RESPECT OF ANY DISPUTE OR CONFLICT IN CONNECTION WITH THIS AGREEMENT.
Governing Law and Jurisdiction. These terms shall be governed by and construed under the laws of the District of Columbia, without regard to conflicts of law. Any controversy or claim arising out of or relating to these terms shall be brought only in the state courts empowered to enforce this Agreement located in the District of Columbia, or the federal courts located in the District of Columbia, as applicable, unless otherwise specified. The parties hereto specifically consent to personal jurisdiction of said courts, and hereby waive any objection thereto based on personal jurisdiction or venue.
Disclaimer of Responsibility. The Company Parties are not liable for items left, lost, stolen, destroyed, confiscated, damaged or misplaced anywhere at the Event site regardless of fault or reason, so act accordingly. Any losses are subject to the terms outlined above. It is advised not to bring valuables to the Event.
Entire Agreement. You unconditionally agree that the terms and conditions contained herein and/or referenced herein represent the entire agreement between You and the Company, and shall supersede and replace all prior contemporaneous understandings, communications, and agreements, written or oral, regarding such subject matter which contradict these terms, including, but not limited to, the text contained on the back of the actual Ticket and/or any contrary understanding or agreements between You and the Company. You further confirm that there are no other agreements between You and any of the other Company Parties. You unconditionally agree to be bound by all the terms and conditions contained herein and/or referenced herein and any additions, changes and/or modifications thereof, which may be made from time to time without prior notice to You. Any updates to Company’s new terms and conditions will be posted to Company website. You have an obligation to check the website for updates to these terms and conditions.
Severability. If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect. 
Validity. If any term or provision is found, by a tribunal of competent jurisdiction, to be invalid, illegal or otherwise unenforceable, the unenforceable provision(s) shall not affect the otherwise valid terms, provisions, spirit of, or the whole of this Agreement. The applicable terms or provisions shall be deemed modified to the extent necessary to render such provision enforceable, and the rights and obligations of the parties shall be construed and enforced accordingly, preserving to the fullest permissible extent, the intent and agreements of the parties set forth in this Agreement.
